The Alberta Court overturned an arbitrator's decision on Safeway wage increases

Emerging Issue – Labour and Employment Law

In Sobeys Capital Incorporated v. United Food and Commercial Workers, Local No 401, 2024 ABKB 614 the Court of King’s Bench of Alberta set aside an arbitrator’s decision to accept the union’s offer in a collective bargaining dispute with Sobey’s. The Court found that the arbitrator’s refusal to account for other Alberta collective bargaining agreements was weak and lacked meaningful analysis. To find out more about the reversal of the arbitrator’s order, please review the Law360 Canada article here.
